You're right, but it looks like it wouldn't be too hard to straighten it up and put one thicker washer on it that fits correctly instead of the off-centered ones that are stressing more on the one side.

Been there ,done that.
If the seller said hey, it's got a problem, and you're going to need to spend some time and money to get it fixed ,then I have no problem with the sale.
I don't think it's an original Fibes throw either as the tension knob is too small.
